an “uncontested divorce” is the most economical and
least stressful option to resolve your marital differences.
What
is the difference between a Dissolution of Marriage and an Uncontested
Divorce?
A dissolution of marriage is where the parties jointly petition
the court to dissolve their marriage; whereas, with an uncontested
divorce, one party files a complaint with the court. In both instances,
the parties have prepared and signed all of the necessary final
documents before anything is filed with the court. Practically
speaking, the primary difference between a dissolution of marriage
and an uncontested divorce is the required attendance at the final
court hearing. With a dissolution of marriage both parties must
attend the final court hearing; whereas, with an uncontested divorce
only the Plaintiff need attend the final hearing, along with a
witness. An uncontested divorce is often used when one of the spouses
resides outside of the state of Ohio or does not wish to attend
the final court hearing.
Resolving marital differences by agreement, either by dissolution
of marriage or an uncontested divorce provides the parties control
over how they wish to end the marriage. Should children be involved,
a dissolution of marriage and uncontested divorce allows the parties
to craft a custody arrangement and parenting schedule that is tailored
to their specific lifestyles and work schedules.
If at all possible, I recommend resolving marital differences by
agreement using a dissolution of marriage or uncontested divorce.
